1. Acceptance of Terms

By accessing or using the services of TARI CONSTRUCTION COMPANY LTD, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions, you may not use our services.

2. Description of Services

TARI CONSTRUCTION COMPANY LTD provides construction services including but not limited to building construction, general civil works, concrete works, finishes, water and waste-water reticulation services, building maintenance, renovations, architectural design, and project management and consultancy services.

3. Project Agreements

All construction projects will be governed by a specific project agreement that details the scope of work, timeline, payment schedule, and other relevant terms. These project agreements will incorporate these general Terms of Service by reference.

4. Client Responsibilities

Clients are responsible for:

• Providing accurate and complete information regarding project requirements.
• Securing necessary permits and approvals unless explicitly agreed that TARI CONSTRUCTION will handle this.
• Site access and cooperation with the construction team.
• Timely review and approval of project milestones.
• Adhering to the agreed payment schedule.

5. Payment Terms

Payment terms will be specified in the project agreement. Typically, this includes:

• An initial deposit before work commences.
• Progress payments at predefined project milestones.
• Final payment upon project completion and client acceptance.

Late payments may incur interest charges and could result in work stoppage until payment is received.

6. Project Changes

Any changes to the agreed scope of work must be documented in writing and may affect the project timeline and costs. TARI CONSTRUCTION reserves the right to adjust the project timeline and costs accordingly.

7. Warranties

TARI CONSTRUCTION COMPANY LTD provides a warranty on workmanship as specified in the project agreement. This warranty does not cover damage caused by normal wear and tear, improper use, or lack of maintenance.

8. Limitations of Liability

TARI CONSTRUCTION’s liability is limited to the remedies specified in the project agreement. We are not liable for indirect, incidental, or consequential damages arising from the construction project.

9. Termination

Either party may terminate the agreement as specified in the project contract. Early termination may result in fees for work completed and costs incurred.

10. Dispute Resolution

Any disputes will first be addressed through good-faith negotiation. If resolution cannot be reached, the matter will be resolved through arbitration in accordance with the laws of Kenya.

11. Governing Law

These Terms of Service are governed by the laws of Kenya.

12. Amendments

TARI CONSTRUCTION reserves the right to amend these terms at any time. Clients will be notified of significant changes.
